No clean break court order in divorce means no protection in the future.

Sometimes it does feel like this is all we talk about as a family team on Social Media, but the reality is that this continues to be a major problem with many people we speak to. Every week we speak to someone who did the divorce without using a solicitor. We always ask them two questions:

  1. Did you reach an agreement about the house, pensions, savings etc?

  2. If so, did you then put that in to a clean break Financial Order and file it at court for a District Judge to approve?

Without fail the answer to 2 is always NO, we didn’t know you had to. We then have the difficult conversation about their ex spouse, sometimes of many years or even decades, still having valid claims against them. If the ex spouse was the one who brought the divorce, we talk about those claims being valid for the rest of their life until there is a court order. We see faces turn pale as they consider the accumulation of wealth over the years that they thought was safe and is now at risk.
