All divorce in England and Wales is based on the irretrievable breakdown of the marriage. Since April 2022, the law has moved to a no-fault system, removing the need to rely on five supporting facts. A divorce application can now be made by one or both parties.

Once the application is issued by the court, there is a 20-week period before you can apply for a Conditional Order (formerly Decree Nisi). During this time, the court expects couples to reach agreement on financial arrangements and any matters involving children. After the Conditional Order is granted, there is a further cooling-off period before the Final Order is made.
