The result of the most recent election in the UK has brought about a number of proposed changes to Employment Law.

The most noteworthy of these changes, as revealed in the King’s speech, is the newly proposed Employment Rights Bill.

If approved, unfair dismissal would become a day 1 right for employees, bringing an end to the current threshold of 2 years of employment before making a claim for unfair dismissal, which has fluctuated since the right was introduced in 1971 – at no time since introduction has this been a day one right. The government’s aim is for this change to strengthen job security for employees

We are still awaiting further details in relation to this change, but from an employer’s perspective, this alteration is expected to significantly increase the number of tribunal claims.

This is the most concrete proposal, but other changes are set to involve strengthening legislation on the ‘fire and rehire’ practice, as well as banning zero-hour contracts.

It remains to be seen whether this bill will be approved and passed as an Act in its current state, but we can expect the final text to be laid before Parliament by the 12th October 2024.
